International Business Machines Corporation (IBM) grants you the following non-exclusive licence free of charge:
IBM authorizes you to use the Design Pattern Builder by entering data parameters in the designated fields on the screen, and to receive the source code generated from these data parameters.
IBM also authorizes you to receive, copy and redistribute the sample source code generated from the default parameters for "An Example".
The Design Pattern Builder also contains a makefile and a foundation class library. IBM authorises you to download these files to your own system in order to compile any source code you receive that has been generated from the Design Pattern Builder. You may not otherwise copy, transfer, modify, merge, reverse compile, sublicense, rent, lease or otherwise assign any of the code in these files.
IBM DOES NOT authorize you to receive or copy any other files, screens or templates of the Design Pattern Builder itself, or to receive, copy or publish in any way any code generated from data parameters of any other user of the Design Pattern Builder.
IBM reserves the right to discontinue availability or change the Design Pattern Builder at any time without notice.
User files containing the data parameters created by the use of the Design Pattern Builder are accessible by others and may be overwritten. IBM shall have no obligation of any kind with respect to such user files or to the information contained within them or to any other feedback provided by users of the Design Pattern Builder, and shall be free to reproduce, disclose and distribute the information and feedback to others without limitation. Further, IBM shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever including but not limited to developing, manufacturing and marketing products incorporating such information.
Any source code generated through the use of the Design Pattern Builder may define a product, process or technology that is the subject of other intellectual property rights reserved by IBM or by others, and may not be licensed hereunder.
The Design Pattern Builder is an experimental tool and is provided AS IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Furthermore, IBM accepts no liability whatsoever, either in contract or in tort, for any damages you may suffer as a result of your use of the Design Pattern Builder, including any damages claimed by you, as a result of third party claims. In no event will IBM be liable for any indirect, special or consequential damages, even if IBM has been advised of the possibility of their occurrence. Some jurisdictions do not allow the exclusion or limitation of warranties or consequential or indirect damages, so the above exclusion may not apply to you.
Use of the Design Pattern Builder is entirely at the user's own risk. No reliance should be placed on any code generated without full testing and debugging by the user.
